  • Mô tả: The Achabal case deserves to be given attention because it raises some important issues regarding the reasoning practice of the Court in inadmissibility decisions. This article will first briefly summarise the case and the HRC's main findings (Section 2). After discussing the main direct consequences of the HRC's views (Section 3), criticism of the approach taken by the Court is further explored (Section 4). In particular, attention is paid to the lack of reasoning in admissibility decisions and the lack of appropriate standards in deciding whether a case is to be declared manifestly ill-founded. In the conclusion (Section 5), the Court is invited to take the HRC's criticism seriously and work towards a better reasoning in inadmissibility decisions. Adapted from the source document.
